I think you are getting confused with a patent and plagiarised source
code.

SCO tripped up when they said that IBM copied code they own and placed
it in Linux.

MS is claiming patents on things like look and feel and the way things
work.

IBM sued Amazon claiming patent infringement on their website.
Apparently Amazon was selling goods through an interactive interface
which IBM patented back in the 1990's. It seams that anyone now who
is running an online store can be subjected to a patent claim by IBM.

You want to complain about frivolous patent claims, why don't you
start with that one?
