Look at the matter logically: As a simple matter of copyright title,
such a statement _could not_ possibly have any force over codebase
instances to which SUSE/Novell, the company, lacked title. Which is 98%
of the CD contents, about.
It seems obvious to me that the old "redistribute freely as long as it
is not part of an exchange for value" statement (paraphrased) was
intended to concern the included copy of YaST/YaST2 and similar code.

For quite a few years prior to that, I repeatedly discussed the matter
with representatives of the SUSE Linux, Inc. subsidiary (mostly people
at the Oakland office). They invariably quoted or paraphrased that
licence statement to me, with (evidently) the very most benign and
generous intent. I always told them that their attitude reflected great
credit on their firm, but then pointed out the complication posed by
third-party rights.
They always seemed genuinely surprised by that, so I think your surmise
is probably correct.
