nVidia is a graphics *processor* manufacturer, not a graphics *card*
manufacturer. As such, they have to make all the necessary documentation
available for their processors that is necessary to write a driver.
They only need to make it available to bona fide customers and can do that
under NDA.
It is not in the interest of any processor manufacturer however to
make it difficult to use their products. They want to sell their
processors after all!
But even if they do that, anyone that has a somewhat related business
will still be able to get documentation, just they can't release that
documentation of course.
Which is perfectly fine, don't need to release the documentation to
create a driver and release the driver. The source to the driver
wouldn't be public at that point in time but there'd be at least a
driver.
And hey, if nVidia really were to block every possible way via some
legal means, whatever....then there always still is ATI.
