You don't have to copy code to infringe on a patent or violate I.P. laws.

The site is asking for the part of the Linux code that infringes on Microsoft's IP; ie the code which implements their IP. (mefinx)

That's why you shouldn't be able to patient something you didn't invent or
anything that is blatantly obvious.
