Europe is not in the "1st world"?
In fact in the US they were on the verge of not only winning the right to
use the mark LINSPIRE but also getting Microsoft's WINDOWS mark voided. In
desperation Microsoft paid them a large sum of money to drop the case and
change the name to Linspire. I expect that the shareholders considered
that a victory. They were not fighting the "war" you want them to have
been fighting.
