ext3.fs: Existence of file and directory with the same name

Hello,
there's a strange situation on my ext3 home drive:
-rwxr-xr-x 1 till users 144956 2007-07-23 17:14 cbFlood
drwxr-xr-x 2 till users 4096 2007-07-24 10:38 cbFLood
As you can see, there's a file AND a directory with the exact same name!
This seams to be no issue for the shell tools like "ls"...
But other tools (like rsync) of course cant handle it.
Running fsck didn't change anything.
Any idea? or is this a "feature" of ext3 i never heart about before?
