Not all providers of closed source kernel modules respond to kernel API changes as quickly as end-users would like. In some cases it's simply a lack of will on the part of the developer (they know it works with kernel x.y.z so they feel their users should just stick with that). In other cases, it's that the developers don't have the resources to devote to checking their closed source modules against every kernel that comes along.

In any case, there are lots of reasons why closed source kernel modules sometimes lag behind current kernel revisions. If those kernel modules were open source instead, that wouldn't happen because the kernel developers are willing to keep open source kernel modules up to date.
