then would it be more likely that the monitoring is not happening necessarily within the kernel but rather within the networks we operate on? i.e. monitoring outside of ISP control... or is it still 'possible' that this 'snippet' is actually in all of the OSes we use today?

It won't do you any good. Pursuant to Public Law 106-58, all computer
cells are interconnected and accessible to government monitoring at
any time regardless of operating system. It was about this time that
hidden microphones and cameras were mandated for all PCs and television
sets sold in the United States.
