Shoplift a $9 item from a store and it's stealing, with legal consequences
that include a criminal record. Tell me someone got a criminal citation for
operating a server without paying the commercial premium charged by their
ISP. You can't. Many people have had their service terminated for doing so
in violation of their TOS, however.
Ahh, I see the form of your argument:
1) Shoplifting is stealing.
2) You can go to jail for shoplifting.
3) You can't go to jail for violating a TOS.
4) Therefore violating a TOS is not stealing.
Let's try this argument out.
1) Elephants are animals.
2) You can ride on an elephant.
3) You can't ride on a cat.
4) Therefore cats are not animals.
Nope, I guess that doesn't work. Nice try though.
